Anti- Gambling Group Challenges Legality of DFS In New York
The state of New York is one of the key states for DFS operators like FanDuel and DraftKings. The recent legal victory for DFS operators in the big apple is seen as the move that has calmed the stormy waters the DFS sector has been going through in the last 12 months.
Governor Andrew Cuomo’s’ recent legalization of DFS in New York was welcomed by DraftKings and FanDuel but has now being challenged by anti-gambling groups. The latest interest group to challenge this is the Stop Predatory Gambling advocacy group. The SPG have announced they will be challenging the constitutional legality of Governor Cuomo’s’ recent law which is based on the notion that DFS is s game of skill and not chance.
Attorney Neil Murray of the firm O’Connell and Aronowitz said in a statement,” The plaintiffs seek to protect the public from predatory gambling consistent with the Constitution. They also intend to stop FanDuel, DraftKings and other internet gambling operators from exploiting the financially desperate and the addicted in New York.”
FanDuel and DraftKings were quick to respond and said,” The state constitution specifically gives the legislature the power to define what is – and what is not – gambling, and the legislature has done so a number of times in the past and long before the emergence of fantasy sports. The Attorney General, who certainly has had some strong opinions about fantasy sports, has clearly stated he will enforce and defend this new law. This is a layup – they have no case.”
The battle of whether DFS is legal in New York however seems to be settled despite the latest attempt by the SPG. Even AG Eric Schneiderman said after Gov. Cuomo’s passing the law legalizing DFS that he would enforce and defend the new law.
